ㅇ 주택법 제43조 및 같은 법 시행령 제50조에 의하여 구성된 입주자대표회의는 민법 제32조에 의한 비영리법인이 아닙니다.
ㅇ 난방용보일러, 엘리베이터 및 보안시설 등의 유지보수 및 교체는 주택법 제51조 제1항에 따라 적립하는 장기수선충당금을 사용하는 주요 공사범위에 해당하므로 입주자대표회의에서 이에 소요되는 금액을 금융기관 등으로 부터 대출을 받거나 차입하여서는 아니 됩니다.
