질의 : 입주자대표회의 결의에 따라 비공개 ‘내정가’에 근접한 최고가 입찰자를 공사업자로 선정할 수 있는지. 회신 : 주택관리업자 및 사업자 선정지침 제16조 제2항에서 ‘관리주체는 제1항에 따른 입찰공고시 건축사 또는 기술사 등 관계전문가의 확인을 받아 입찰가격 상한을 공고할 수 있다’라고 정하고 있다. 따라서 관계전문가의 확인을 받아 입찰공고시 공고 내용에 입찰가격 상한을 공고할 수 있지만 낙찰의 방법은 적격심사제 또는 귀 공동주택의 관리규약으로 정하는 내용에 따라 최저낙찰제로 해야 한다.<주택건설공급과 전자민원, 2013. 7. 23.> <국토교통부 제공> |
