산재근로자에게 일시보상후 해고가능 여부
근로자가 업무상 부상 또는 질병의 요양을 위하여 요양중에 있는 때에는 사용자는 당해
근로자를 해고하지 못함.
다만 사용자가 근로기준법 제87조에 규정된 일시보상을 행하였거나, 근로자가 산업재해보
상보험법에 의한 상병보상연금을 지급받고 있는 경우에는 해고할 수있음.
