ㅇ 공무원도 공동주택의 입주자인 경우에는 입주자대표회의의 구성원인 동별대표자가 될 수 있습니다. 다만, 국가공무원법 제64조제1항에 따라 공무원은 공무 외에 영리를 목적으로 하는 업무에 종사하지 못하며 소속 기관장의 허가 없이 다른 직무를 겸할 수 없도록 규정하고 있습니다.
ㅇ 따라서 공무원이 주택법시행령 제50조에 따른 입주자대표회의의 구성원(동별대표자)을 겸직할 수 있는 허가 등의 절차에 관한 사항은 행정안전부로 문의하시기 바랍니다.
